Žemės teisinio reguliavimo problemos Lietuvoje

Baigiamajame magistro darbe nagrinėjamos Lietuvos žemės teisinio reguliavimo problemos (lyginant su Vokietijos žemės reguliavimu). Aprašoma žemės sąvoka, žemės teisinė bazė, nurodomos žemės valdymo sistemos institucijos ir jų atsakomybės. Taip pat pristatoma istorinė Lietuvos žemės valdymo apžvalga nuo Sovietų Sąjungos okupacijos iki šių dienų. Aprašoma VĮ Registrų centro veikla, nekilnojamojo turto kadastro ir registro turinys. Trečiajame skyriuje pristatoma Vokietijos žemės teisinio reguliavimo sistema. Nagrinėjama istorinė sistemos raida, aprašomas žemės knygų turinys ir nekilnojamojo turto kadastras. Įvardijamos institucijos, atsakingos už žemės valdymą Vokietijoje. Ketvirtajame skyriuje atliekama lyginamoji abiejų šalių sistemų analizė. Lyginimas apima istorinius aspektus, turėjusius įtakos sistemų plėtrai, atsakingas už žemės valdymą institucijas, nekilnojamojo turto registrus ir kadastrus, vyriausybės vaidmenį reguliuojant žemę, įstatyminę reguliavimo bazę. Pateikiama analizės rezultatų suvestinė ir išskiriami abiejų sistemų pranašumai ir trūkumai.Išnagrinėjus Lietuvos ir Vokietijos žemės teisinio reguliavimo sistemas ir atlikus jų palyginimą, pateikiamos baigiamojo darbo išvados ir siūlymai. Darbą sudaro 7 dalys: įvadas, sąvokų žodynėlis, žemės teisinis reguliavimas Lietuvoje, žemės teisinis reguliavimas Vokietijoje, lyginamoji Lietuvos ir Vokietijos žemės teisinio reguliavimo sistemų analizė, išvados ir siūlymai, literatūros sąrašas. Darbo apimtis - 54 p. teksto be priedų, 10 paveikslų, 2 lentelės, 24 bibliografiniai šaltiniai.Atskirai pridedami darbo priedai.
In this thesis the issues of legal land regulation in Lithuania are analyzed in comparison with the situation in Germany. The concept of land and legal land base is described, the institutions of land regulation system and their responsibilities are presented. The historical review of Lithuanian land regulation from the times of the Soviet occupation until nowadays is presented. The activities of State Enterprise Center of Registers (VĮ Registrų centras) and the content of register and cadastre are described. In the third chapter the German land regulation system is presented. Its historical development is analyzed, the content of land books and cadastre of real estate is described. The institutions responsible for land regulation are indicated. In the fourth chapter the comparative analysis of both systems is done. The comparison includes historical aspects, which had an impact on the development of the systems, the institutions responsible for the land regulation in both countries, the registers and cadastres of the real estate, the role of government in land regulation and the legal regulation base. The summary of the results of analysis is presented in the table where the advantages and disadvantages of both systems are highlighted.Structure: introduction, dictionary of concepts, legal land regulation in Lithuania, legal land regulation in Germany, comparative analysis of the Lithuanian and German legal land regulation systems, conclusions and suggestions, references.
