Abstract (en)

The problem of the distribution of state power since the times of antiquity has been an important constituent part of the problem of the improvement of the state governing, stregthening of democracy and lawfulness. It is especially significant to post - communist countries, creating democratic, legal states. Ancient and West European thinkers treated the necessity of the state power distribution as well as the interdependence and interaction of its constituent parts differently The classical form of the theory of the distribution of state power was presented by Ch. L. Montesque in which the mechanisms of legislation, the competence of the executive and judicial powers, their interaction, control and activities are determined.
